No pension shall be granted to any public servant who shall not have

body, to discharge the duties of his situation : nor unless he shall have discharged those duties with diligence and fidelity, to the satisfaction of the head of his Department. And in case the officer claiming much pension shall be harself the head of a Department; then such pension shall not be granted
unless he shall have dischayed the duties of his office with zeal and fidelity to the satisfaction of the Governor by whom the same shall be certified to the Secretary of State..
